RE: Frances McMenamin QC

Ostensibly, Frances McMenamin QC seemed to be on the side of justice, due process and decency when we observed her in action defending Robert before Sheriff Principle Bowen at Stonehaven Court on 14th November.What happened on the morning of 15th was therefore disappointing.

We would very much prefer to think that such a personable and competent senior lady barrister will not turn out to be part of the ongoing plot to protect paedophiles in Scotland.

We do hope therefore Ms McMenamin will help throw light on why the Scottish Sun reporter was suddenly at the court on 15th in pursuit of a story, but then left as suddenly as he had appeared, not wishing to interview any of those present who had been following the case over many months, knew much of the detail and probably had opinions on it, as might be interesting to Sun readers. Not dissimilar to the manner in which she had also perfunctorily packed her bag and exited down the same stairway, shortly before he did.

I emailed Ms McMenamin on 9th December, using frances.mcmenamin@blackchambers.co.uk

It did not bounce back, so I do not know how Ms McMenamin missed it, given the gravity of the content and the likely implications for her. I shall be meeting the police again soon about possible arrests, but again, please assure all others at Black Chambers that I have no intention of damaging the Chambers` reputation.

As you may know, this is connected to the horrific events in Aberdeen connected to the Hollie Greig story, followed by millions throughout the world, so it would be most unfair for Black Chambers to suffer bad publicity as a result of the unfortunate events surrounding Frances McMenamin.

Dear Mr Burns,

As a matter of courtesy to you and your colleagues at Black Chambers, I have lodged a formal complaint against Frances McMenamin QC with the Scottish Legal Complaints Commission in relation to events that occurred in Stonehaven Court on 15th November 2011. I have also copied in the sheriff that day, Sheriff Principal Edward Bowen and the Secretary of State for Scotland, Mr Michael Moore, as Ms McMenamin`s conduct is overwhelmingly likely to have been connected to possible criminal elements operating in the Crown Office.  

Naturally, a formal complaint has also been made to Grampian Police, with the names of those likely to have been involved with Ms McMenamin being also identified.

I have suggested, in the public interest, that Frances McMenamin be suspended from the Faculty of Advocates whilst a full investigation takes place.

If you wish to look at the Scottish Law Reporter`s article of 9th December 2011, I believe that you will appreciate the gravity of the allegations against your colleague and suggest you circulate this email to all those at Black Chambers. I have no wish that anyone else`s reputation should suffer through any innocent association with Ms McMenamin.

As I had no wish to make allegations should a lawful explanation exist, I gave Ms McMenamin the opportunity to offer some reason for her conduct in an email as soon as the article was published. To date, no response has yet been received. Likewise, the Crown Office and the Editor of the Scottish Sun, David Dinsmore have declined to respond to polite questions.
